Yan Wei shares LED downlights in the United States encountered lighting science group infringement lawsuit

On the 11th of this month, the US Lighting Science Group Corporation filed a lawsuit against Shenzhen Weiwei Photovoltaic Lighting Co., Ltd. and Weiwei Technology (USA) Co., Ltd. to the California State Court to file a patent infringement lawsuit (Lighting science group corporationv. Shenzhen Jiawei & Jiawei USA, 3:16-cv-03886). Lighting Science Group Inc. alleged that an LED downlight (product number: DLS03-06E30D1E-WH-F1) of Shenzhen Weiwei Company is all of its US Patent No. 8201968 ("968 Patent"), No. 8672518 (" 518 patents "), and No.8967844 ("844 patents") three patent infringements, and apply for a temporary injunction to prohibit infringing products from continuing to import into the United States, and prohibit the continued sale of imported products.

The three patents involved in the investigation are all "profits" used in patent litigation in recent years. For example, the "968 patent" was carried out in 13, 14 and 16 years with CREE, Cooper Lighting, USALightElectric, Globalux Lighting and other companies. Patent litigation.

The plaintiff, Lighting Science Group Corporation, is a developer and integrator of global LED lighting solutions, a designer and manufacturer of super energy-efficient LED solutions. In 2007, LED Holdings, a global leader in custom LED lighting solutions, contributed all of its assets to the Lighting Science Group for the exchange of fully diluted preferred stock equivalent to 70% of the shares of Lighting Science Group and 80% of voting shares. Shares, the name of the Lighting Science Group is still used after the merger.

The defendant Shenzhen Weiwei Photovoltaic Lighting Co., Ltd. was established in 1993 and listed on the Shenzhen Stock Exchange in 2012, becoming the first share of the Chinese capital market photovoltaic and LED lighting industry. The company is mainly engaged in the research and development, production and sales of photovoltaic lighting products. The main products include solar lawn lights and solar garden lights, which are widely used in lighting, lighting or landscape decoration in courtyards, public green spaces, roads and squares. It owns MAXIUM, YARDS & BEYOND, EZSOLAR and other independent brands overseas. It is a supplier of many European and American retail giants such as WAL-MART, THEHOMEDEPOT, LOWE'S, TARGET, TRUEVALUE, CTC, ACE, BIGLOTS, etc. It is TARGET 2010 "outstanding partner". TRUEVALUE "The most trusted strategic partner in the world". It has wholly-owned subsidiaries in Hong Kong, North America and Europe, and a warehousing and logistics distribution center in the United States. It has developed into one of the solar energy and LED lighting application enterprises with the largest scale of production, the highest level of technology, the strongest independent innovation capability and a complete research, production and sales system.

This is not the first time that Weiwei Company has been sued by foreign companies. In November 2009, Nichia sued Shenzhen Jiawei and its North American and Hong Kong branches in the federal court of the Eastern District of Texas for infringement of three white LED patents (US5998925, 7026756, 7531960) and an LED chip patent (US6870191). In May 2010, Nichia and Yu Wei reached a settlement. In the domestic LED industry, most companies use patent litigation as a passive defense, and even at some point, it is only a way of promoting the company's popularity and influence. The export of products is also based on the evasion policy. After being sued for infringement, most companies chose to settle with the plaintiff for various reasons such as high litigation costs and insufficient energy, and paid a large amount of patent license fees.

China has become the world's largest producer and exporter of LED lighting products. It is not uncommon for domestic LED companies to be sued by foreign companies for patent infringement. Litigation will increase the cost of enterprises and lose the original price advantage. How to avoid reducing the risk of exporting intellectual property rights infringement is a problem that China's LED industry export enterprises are urgently concerned about.
