The first is to strengthen the planning, construction and management of urban night lighting, beautify the city's night scene, and improve the urban environment, according to the "People's Republic of China Urban Planning Law", "Regulations on Urban Cityscape and Environmental Sanitation Management of the State Council", "Implementation Measures of Henan Province" These regulations are formulated in accordance with the provisions of relevant laws and regulations and in combination with the actual conditions of this Municipality.
Article 2 These Measures shall apply to the planning, construction and management of urban night lighting in the urban planning area of ​​this Municipality.
Article 3 The term "city night lighting" as used in these Measures refers to all kinds of lightings set up for lighting and beautifying the city's night scene.
Article 4 The planning and construction of urban night lighting shall adhere to the principles of unified planning, step-by-step implementation, government supervision, and social participation.
Article 5 The Municipal Urban Planning and Construction Committee shall be responsible for the review and decision-making of the urban night lighting lighting planning, road lighting and design projects for important regional building (structure) building lighting installation projects.
Article 6 The Municipal Urban Administration Bureau is the administrative department in charge of the city night lighting management (hereinafter referred to as the municipal city management department), and is responsible for the organization and implementation of these measures.
The municipal construction, planning, power supply, environmental protection, transportation, industry and commerce, quality and technology supervision, tourism, public security and other departments shall, in accordance with their respective responsibilities, coordinate the city night lighting management work.
The city street lighting management agency is responsible for the management of road lighting and financial investment construction lighting projects.
Article 7 Encourage units and individuals to actively install night lighting, strengthen scientific and technological research on night lighting, promote new technologies, new processes, new materials and energy-saving lamps, and continuously improve the construction and management level of urban night lighting.
Article 8 The urban night lighting lighting construction plan shall be incorporated into the overall urban construction plan. The municipal city management department shall submit opinions with the municipal construction, planning, finance, power supply and other departments. After being reported to the municipal urban planning and construction committee for approval, the municipal urban administrative department shall organize the implementation.
Article 9 The following areas or buildings (structures) shall be equipped with urban night lighting facilities in accordance with the urban night lighting plan:
(1) Urban roads, bridges, parks, scenic spots, scenic spots, street gardens, gardens, courtyards, green spaces, rivers and other public places;
(2) Buildings (structures) on both sides of the main roads of the city, as well as tall buildings (structures) and important buildings (structures) outside the two sides of the main roads;
(3) Prosperous business district;
(4) City entrances and exits;
(5) Urban sculptures and sketches;
(6) Various types of towers and receiving towers;
(7) Outdoor advertising facilities, store plaques, etc.
Article 10 The planning, design and setting of urban night lighting shall comply with the following principles:
(1) It shall not cause light pollution and affect residents' lives and health;
(2) It shall not affect the normal use of traffic lights and other important sign lights;
(3) It shall not affect traffic safety and normal driving of vehicles;
(4) It shall not affect the normal use functions of buildings (structures), urban greening, and public facilities;
(5) It shall not hinder the appearance of the city and the overall image of the city.
Article 11 Anyone who builds, rebuilds, or expands the building (construction) in the night lighting lighting planning area shall, in accordance with the plan, set up night lighting equipment, and must design, synchronize construction, synchronous acceptance and simultaneous use with the main project.
The municipal construction administrative department shall solicit the opinions of the municipal city management department when conducting the planning and design plan and preliminary design plan review.
Article 12 If the building (structure) that has been put into use is included in the urban night lighting construction plan, the municipal city management department shall issue the “City Night Lighting Construction Task Book” according to the plan, and the owner shall set the night lighting according to the requirements. Facilities and installation units will submit the design plan to the municipal city management department for record within 15 days before construction. For those schemes that do not meet the requirements for night lighting lighting planning, the municipal city management department shall propose modifications to the setting unit within 5 working days and help to improve the design plan.
It is not included in the urban night lighting construction plan. If the owner needs to set up night lighting, the city city management department can guide the location, form and color of the lighting.
Article 13 The design and lighting effects of night lighting shall meet the following requirements:
(1) Comply with the urban night lighting lighting planning requirements, embody the regional functions, construction (structure) architectural features and cultural connotations, and coordinate with the overall landscape;
(2) High-rise residential buildings should be properly equipped with night lighting at the top; high-rise non-residential buildings (structures) should be set up for the overall night lighting of the façade;
(3) The setting of night lighting for parks, scenic spots, scenic spots, river courses and bridges shall fully reflect the historical features and environmental features of places of interest;
(4) Outdoor advertising facilities and store plaques shall be arranged in the form of neon lights, floodlights, spotlights, electronic displays, light boxes, etc.
Article 14 The quality of raw materials and engineering installation used for night lighting shall comply with national regulations, and shall be equipped with protection facilities such as waterproof, fireproof, windproof, anti-leakage and explosion-proof to ensure firm installation and safe use.
Article 15 Units engaged in the design and construction of urban night lighting projects shall have corresponding qualification certificates.
Article 16 No unit or individual may alter, move, damage or dismantle night lighting facilities without authorization.
Article 17 The night lighting equipment shall be maintained by the setting unit (individual) to maintain good function and neat appearance. If the pattern, text, or light is incomplete or dirty, obsolete, or damaged, it should be repaired in time.
Article 18 The night lights of the main roads and key areas of the city shall be opened and closed in accordance with the following time:
(1) Year-round opening and closing time:
1. The opening and closing time from May 1 to September 30 (except the second paragraph): opening at 19:30 every day, closing no earlier than 22:00;
2. The opening and closing time from October 1st to April 30th (except the second paragraph): opening at 19:00 every day, closing no earlier than 21:30.
(2) Opening and closing time of major festivals and major events:
1. Opening and closing time of New Year's Day, Spring Festival, May Day and National Day: From 1st day before the statutory holiday to the day of the holiday, it will be opened every night and extended to 24 o'clock in the evening.
2. If the city's major events require the opening and closing of the city's night lighting, it shall be implemented in accordance with the notice of the municipal city management department.
If it is still required to be opened outside the time specified in this Article, it shall be decided by the owner. If it cannot be opened due to special circumstances, it shall be reported to the competent department of night lighting for the record.
Article 19 Anyone who violates the provisions of these Measures and has one of the following acts that does not meet the urban appearance standards shall be ordered by the municipal city administrative department in accordance with the relevant provisions of the “Regulations on the Regulation of the City of Environmental and Environmental Sanitation in Henan Province” and other relevant regulations. Individuals will be corrected within a time limit.
(1) failing to set up night lighting facilities or performing night lighting projects in accordance with the urban night lighting lighting planning requirements;
(2) arbitrarily changing, moving, damaging or dismantling the night lighting fixtures;
(3) failing to open and close the night lighting fixtures as required;
(4) The night scene lighting facilities pattern, text, lighting display is incomplete or dirty, old and damaged, and is not maintained, repaired or replaced in accordance with the requirements of the municipal city management department.
If the above acts violate relevant laws and regulations, they shall be handled in accordance with other relevant regulations.
Article 20 If the intentional damage or theft of night lighting facilities is refused or the city management personnel are refused or hindered from performing official duties according to law, the public security department shall impose penalties in accordance with the Regulations of the People's Republic of China on Public Security Administration Punishment; if a crime is constituted, criminal responsibility shall be investigated according to law.
Article 21 The Municipal Urban Administration Bureau shall be responsible for the interpretation of these Measures.
Article 22 These Measures shall be implemented as of the date of promulgation.
